1. Acceptance of Terms

By accessing or using HGMN website design services ("Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services.

2. Description of Services

HGMN provides professional website design, development, hosting, and related services for local businesses. Our Services include custom website design, SEO optimization, content management, hosting, SSL certificates, and optional AI-powered chat capabilities.

3. Subscription and Payment

Our Services are offered on a subscription basis. The Managed Website is $249 per month with no setup fee. The AI Website Assistant is an additional $99 per month. Payments are due at the beginning of each billing cycle. All fees are non-refundable except as expressly stated in these terms.

4. Cancellation and Termination

Please contact us to discuss cancellation. We aim to make the process straightforward. Upon cancellation, your website will remain active until the end of your current billing period. After termination, HGMN will provide you with an export of your website content upon request. HGMN reserves the right to terminate service for violation of these terms with immediate effect.

5. Intellectual Property

Upon full payment, you retain ownership of all content you provide (text, images, logos, etc.). HGMN retains ownership of the underlying code, design elements, and technical infrastructure. You are granted a perpetual, non-exclusive license to use the delivered website code for your business.

6. AI Add-On Usage

The AI Add-On includes up to 200 AI-powered conversations per month. Conversations exceeding this limit may incur additional charges. HGMN does not guarantee specific outcomes from AI interactions. Customers are responsible for monitoring AI-generated responses for accuracy.

7. Limitation of Liability

HGMN provides its Services on an "as is" basis. To the maximum extent permitted by law, HGMN shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our Services. Our total liability for any claim shall not exceed the amount paid by you for Services in the preceding 12 months.

8. Uptime and Hosting

HGMN strives to maintain 99.9% uptime for hosted websites. In the event of service disruption, we will work diligently to restore service. Hosting is included in your subscription while your account is active.

9. Changes to Terms

HGMN reserves the right to modify these terms at any time. We will notify active subscribers of material changes via email. Continued use of our Services after changes take effect constitutes acceptance of the modified terms.
